Prescription Drug Distribution in New Jersey: N.J.S.A. 2C:35-10.5

All crimes related to the Possession, Possession With Intent to Distribute, and Distribution of Prescription Drugs are addressed by N.J.S.A. 2C:35-10.5, which mandates:

A person who knowingly:

1. Distributes a prescription drug in an amount of four or fewer units (pills) is a disorderly person;
2. Distributes or possesses with intent to distribute a prescription drug in an amount of four or fewer units (pills) is guilty of a crime of the fourth degree;
3. Distributes (sells) OR possesses with intent to distribute a prescription drug in an amount of at least five but fewer than 100 units (pills) is guilty of a crime of the third degree; A fine of up to $200,000 may be imposed for a conviction under this subsection
4. Distributes (sells) OR possesses with intent to distribute a prescription drug in an amount of 100 or more units (pills) is guilty of a crime of the second degree; A fine of up to $300,000 may be imposed for a conviction under this subsection

Penalties for Distribution of Prescription Drugs in New Jersey

As mentioned previously, a charge for distributing, dispensing, or possessing prescription medication with intent to distribute is contingent upon the amount of the drug, specifically, the number of units or pills, associated with the alleged offense. These classifications are distinguished as follows:

Prescription Drug Distribution as a Second Degree Crime: Involves 100 or more units or pills; punishable by a term of incarceration ranging from 5 to 10 years in New Jersey State Prison, as well as a maximum fine of $300,000

Prescription Drug Distribution as a Third Degree Crime: Involves a number of units or pills between 5 and 100; punishable by a term of incarceration ranging from 3 to 5 years in New Jersey State Prison, as well as a maximum fine of $200,000

Prescription Drug Distribution as a Fourth Degree Crime: Involves 4 or fewer units or pills; punishable by a term of incarceration of up to 18 months in New Jersey State Prison
