Pursuant to New Jersey Revised Statutes Section 2C:52-5 – Expungement of record of young drug offenders, individuals who committed drug-related crimes when they were aged 21 or younger may have those criminal records expunged. However, if the offenses included distribution or possession with intent to distribute a controlled substance, they may not be eligible. Offenses are eligible for expungement where:

  • The offender was 21 years old or younger when the offense took place
  • The offense was simple possession of a controlled substance OR
  • The offense was possession with intent to distribute hashish of five (5) or fewer grams or possession with intent to distribute marijuana in an amount of 25 or fewer grams
  • Associated parole or probationary periods have been served with no violations
  • The offender has not committed any additional drug-related crimes as per the New Jersey Comprehensive Drug Reform Act of 1987
