It can be difficult to bridge the gap between understanding why Oxycontin and Percocet are so frequently prescribed and also why they can be so dangerous when used recreationally. Unlawful possession with the intent to distribute prescription drugs is governed by New Jersey Revised Statutes Section 2C:35-10.5 – Prescription legend drugs. Essentially, possession of any prescription drug such as Oxycontin or Percocet with the intention to distribute, particularly if that distribution involves a financial transaction, is treated very similarly to distribution of illegal drugs such as marijuana, cocaine, heroin, synthetic marijuana, and so on. Pursuant to the above regulations, here are the charges and penalties for possession and distribution of Oxycontin and Percocet:

• Disorderly persons charges may stem from possession with intent to distribute no more than four (4) doses of Oxycontin or Percocet where the distribution involves no financial gain. Convictions can come with up to six (6) months in county jail and maximum fines of $1,000
• Fourth degree felony charges may be filed when the offender possesses with intent to distribute no more than four (4) doses of Percocet or Oxycontin for the purpose of financial gain. Convictions may lead to up to 18 months in county jail and fines up to $10,000
• Third degree felony charges may result from possession with intent to distribute between five (5) and 99 doses of Percocet or Oxycontin for financial gain. Convictions may come with prison sentences up to five (5) years and maximum fines of $200,000
• Second degree felony charges may be filed where the distributed Percocet or Oxycontin was in the amount of 100 or more doses with the intention of financial gain. Sentences can include up to ten (10) years in state prison and fines up to $300,000. Second degree convictions also come with a presumption of incarceration, which means that even first time offenders can expect to serve time in prison
