Authorities filed child pornography possession and distribution charges against 41-year-old Nathan Brochstein, who hails from the Wayside section of Ocean Township, after an extensive investigation. Police reportedly confiscated his computer and his external hard drive in November of 2012, which led to their discovery of more than 600 child pornography images as well as videos that he had been transferring over the Internet.
Brochstein was likely charged with multiple counts of endangering the welfare of a child, which is the legal term that encompasses offenses involving child pornography in New Jersey. Specifically, endangering the welfare of a child is governed by N.J.S.A. 2C:24-4, which prohibits conduct related to child pornography. For example, the statute mandates:
A person who knowingly receives for the purpose of selling or who knowingly sells, procures, manufactures, gives, provides, lends, trades, mails, delivers, transfers, publishes, distributes, circulates, disseminates, presents, exhibits, advertises, offers or agrees to offer, through any means, including the Internet, any photograph, film, videotape, computer program or file, video game or any other reproduction or reconstruction which depicts a child engaging in a prohibited sexual act or in the simulation of such an act, is guilty of a crime of the second degree.
An individual convicted of a second degree crime may be sentenced to a term of imprisonment ranging from 5 to 10 years. However, endangering the welfare of a child offenses that involve sexual misconduct may also entail penalties such as mandatory sex offender registration under New Jersey’s Megan’s Law.
