According to officials from the Monmouth County Prosecutor’s Office, 29-year-old Jackson resident Nicholas DePue is accused of having multiple sexual encounters with an underage student. He is now facing charges for second-degree sexual assault and second degree endangering the welfare of a child.
Depue was released from custody after posting a $100,000 bond and will be subject to severe penalties if convicted. Among the crimes for which he is accused, endangering the welfare of a child can be classified as a first, second, third, or fourth-degree crime, depending on the circumstances involved with the alleged offense.
In this case, Depue has been charged with second degree endangering because he is considered to have been operating in a supervisory capacity when the alleged conduct occurred. As such, he may be sentenced to serve between 5 and 10 years in New Jersey State Prison.
