According to reports, a break-in occurred at the restaurant and nightclub Porta in Asbury Park on Wednesday, April 22nd. The offender is said to have broken a plate glass window in order to unlawfully enter the premises, at which time he stole two containers of alcohol: a bottle of Llord’s triple sec and a bottle of Stolichnaya orange vodka, the value of which has been estimated at $50. In addition, the value of the broken window has been assessed at $600.
Police investigated the incident, subsequently identifying 47-year-old Daniel Sweeney as the primary suspect. Sweeney is now facing charges for burglary and theft. He was being held at the Monmouth County jail in lieu of bail amounting to $5,000 with no 10 percent option.
With regard to the theft charges he is facing, Sweeney may have been charged with a disorderly persons theft offense, in violation of N.J.S.A. 2C:20-3a. Under this statute, theft offenses can be classified as second, third, or fourth-degree crimes, or disorderly persons offenses. The degree of the charges is contingent upon the monetary value associated with the alleged offense.
Due to the fact that the two bottles were valued at $50, Sweeney may face a sentence to serve up to 6 months in the county jail if he is ultimately found guilty. The court may also require Mr. Sweeney to make restitution payments to compensate for the damaged window if he is convicted.
