Temporary Restraining Orders in New Jersey

Once domestic violence is alleged to have taken place, the alleged victim can pursue a temporary restraining order to protect his or herself and his or her children. Once the restraining order is issued by the court, there will be a hearing within 10 days.

When domestic violence allegations occur in the midst of a contested divorce, the stakes are extremely high as the granting of a final restraining order could result in the alleged abuser being barred from the marital home or spending time with his or her children. For that reason, it is crucial for these issues to be resolved as soon as possible.

Once a final restraining order has been entered, the court has discretion to make decisions with regard to family law issues such as custody, parenting time, child support, alimony and counsel fees. The court will also order monetary sanctions against the defendant.

Restraining Order Violations in New Jersey

If the defendant contacts the plaintiff while the restraining order is in effect, he or she will be forced to serve a mandatory probation term, with a second violation resulting in a mandatory jail term.
